Take notice that public hearing and special Board meeting of the Board of Commissioners of the Housing Authority of the City of El Paso, Texas (HACEP) and regular or special meetings of its affiliated entities listed below listed below will be conducted by videoconference and telephone participation Friday, December 18, 2020 commencing at 12:00 P.M. (Noon) to conduct a public hearing regarding the proposed Annual Plan and Five-Year Plan for fiscal years 2021 – 2025, and possibly act on the items listed below.

Affiliated entity also meeting simultaneously with HACEP include the Board of Directors of the following etity:

                                               Paisano Housing Redevelopment Corporation (“PHRC”)

                               TEMPORARY SUSPENSION OF OPEN MEETINGS LAWS DUE TO EMERGENCY

The Texas Governor temporarily suspended specified provisions of the Texas Open Meetings Act to allow telephonic or videoconference meetings and to avoid congregate settings in physical locations.

Notice is hereby given that a Regular Meeting of the Board of Commissioners of the Housing Authority of the City of El Paso, Texas (HACEP) and its affiliated governmental entities listed above will be conducted on December 18, 2020 at 12:00 PM.  Members of the public may view the meeting via the following:

MEETING AGENDA

1.         Call to order.

2.         Establishment of a quorum.

3.         Opening remarks by the Chairperson.

            a.         Purpose of public hearing.

            b.         Procedures for public comment.

4.         Presentation by staff of proposed Annual Plan and Five-Year Plan for fiscal years 2021 – 2025 under the Quality Housing and Work Responsibility Act/Housing Reform Act of 1998.

5.         Public comment.

6.         Discussion and action regarding resolution approving and authorizing submission of the Housing Authority of the City of El Paso, Texas’ annual and five-year plan for FY 2021 – FY 2025. 

7.         Discussion and action regarding resolution approving acquisition of existing apartments for low-income housing in support of the statutory mission of the Housing Authority of the City of El Paso and its affiliates. 

            a.         Housing Authority of the City of El Paso.  Discussion and action regarding resolution to approve acquisition by the Housing Authority of the City of El Paso or its public facility corporations or affiliates of land and interests in the following apartment complexes:                        

                        i.          Village Sierra Apartments (243 units), 2435 McKinley Ave., El Paso, Texas 79930. 

                        ii.         Wyndchase Apartments (150 units), 1601 McRae Blvd., El Paso, Texas 79925. 

                        iii.        Mesa Place Townhomes (128 units), 5450 Suncrest, El Paso, Texas 79912. 

                        iv.        Franklin Place Townhomes (96 units), 600 Belvidere St., El Paso, Texas 79912. 

                        v.         Cien Palmas Apartments (150 units), 7845 Lilac Way, El Paso, Texas 79915. 

             b.         Paisano Housing Redevelopment Corporation. Discussion and action regarding resolution to approve acquisition by Paisano Housing Redevelopment Corporation of land and interests in apartment complexes listed in a(i) through a(v) above.           

             c.         Housing Authority of the City of El Paso/Paisano Housing Redevelopment Corporation.  Discussion and action regarding resolution to approve formation of limited liability companies or other entities to be owned by the Housing Authority of the City of El Paso, Paisano Housing Redevelopment Corporation, or other public facility corporations/affiliates thereof, in support of the foregoing acquisitions of interests in apartment complexes.  

8.         Executive session.

The Board of Commissioners may go into executive session, or a closed private session, to take up any items on or related to this agenda that may be appropriately taken up in executive session pursuant to the Texas Open Meetings Act, Texas Government Code 551.071 to .076, for such matters as consultation with an attorney on a matter covered by attorney-client privilege, to confer regarding threatened or pending litigation, or to confer regarding real estate, personnel, and/or security matters that may be discussed in a closed session.   No action and no votes will be taken in any executive session.

Anticipated executive session item(s):

             a.         Discussion of real estate transactions and matters.  (Section 551.072)

             b.         Discussion of pending litigation and/or matters involving the advice of legal counsel.     (Section 551.071)

Posting Statement

This notice has been posted at the central offices of the Housing Authority, 5300 East Paisano Drive, and notice has been provided to the El Paso County Clerk more than 72 hours in advance of the above meeting, as required by chapter 551 of the Texas Government Code.

Pursuant to § 30.06, penal code, (trespass by holder license holder with a concealed handgun), a person licensed under subchapter h, chapter 411, government code (handgun licensing law), may not attend this meeting with a concealed handgun.

Pursuant to § 30.07, penal code, (trespass by holder license holder with an openly carried handgun), a person licensed under subchapter h, chapter 411, government code (handgun licensing law), may not attend this meeting with a handgun that is carried openly.
