Take notice that an annual meeting as called for by Section 3.5 of the bylaws of the Housing Authority of the City of El Paso, Texas (“HACEP”) and regular or special meetings of its affiliated entities listed below will be conducted by videoconference and telephone participation Wednesday, February 17, 2021 commencing at 5:30 p.m. Affiliated entities also meeting simultaneously with HACEP include the Board of Directors of the following entities:  Paisano Housing Redevelopment Corporation (“PHRC”), Affordable Housing Enterprises (“AHE”).

                    TEMPORARY SUSPENSION OF OPEN MEETINGS LAWS DUE TO EMERGENCY

The Texas Governor temporarily suspended specified provisions of the Texas Open Meetings Act to allow telephonic or videoconference meetings and to avoid congregate settings in physical locations.

Notice is hereby given that a Regular Meeting of the Board of Commissioners of the Housing Authority of the City of El Paso, Texas (HACEP) and its affiliated governmental entities listed above will be conducted on February 17, 2021 at 5:30 PM.  Members of the public may view the meeting via the following:

To Consider and Possibly Act on the Following:

A.        Preliminary Items

1.         Call to order. (start of meeting for HACEP and all affiliates with a posted agenda)

2.         Re-appointments of Commissioners Eileen Karlsruher, Anna Perez, and Yadira Beltran.

3.         Establishment of a quorum. (for HACEP and all affiliates with a posted agenda)

4.         Resident Association Presidents to be heard.

5.         Public comment.  (Citizens to be heard)

6.         Approval of minutes. (for HACEP and all affiliates with a posted agenda)  

            a.  HACEP/AHA/APFC/PHRC/AHE.  Approval of minutes of a regular joint meeting that took place on January 20,   2021.

            b.   HACEP/PHRC/AHV.  Approval of minutes of a special joint meeting that took place on February 5, 2021.

B.        Consent Agenda Items

            Matters posted under the consent agenda will be considered by the Board of Commissioners as a routine matter and will be enacted by one single motion unless separate discussion is requested by a member of the Board of Commissioners.  When the consent agenda vote has been taken, if an item has not been called out for separate discussion, the item will be approved along with any and all other consent agenda items approved at the same time.   The Board may reconsider any item at any time during the meeting.   The wording of all agenda items shall appear in the minutes of the meeting as posted, unless otherwise revised by this or other motions made and approved during the meeting, without the necessity of staff reading the wording by each item into the record. 

7.         HACEP Consent agenda:  Purchasing and construction contract and purchase order awards:

           A.  Request that the Contracting Officer be authorized to sign extension to contract for temporary employment services contract # HR 17-C-0018 A-E.  This is the fourth renewal of four.  These contracts were procured through the request for proposal (RFP) process.  The recommendation is as follows:                                                                                   

           Department:  Human Resources

          Award to:  HG Arias & Associates, TruTemps, 22nd Century, RMP Personnel, Global Technologies

          $215,000 combined estimate

          Funding Source:  COCC

          Procurement Type:  Request for proposal

          Contract Term:  12 months

          B.  Request that the Contracting Officer be authorized to sign contract for architectural services for RFQ # TS-20-Q-0014 for JC Machuca Apartments.  Contract term requested is for the duration of the design and construction period of this project.  These services were procured through the request for qualifications (RFQ) process.  The recommendation is as follows:

           Department:  Development

           Award to:  Wright & Dalbin Architects

           $413,000 estimated

           Funding Source:  COCC

           Procurement Type:  Request for qualifications

           Contract Term:   New contract

C.        Regular Agenda:  General Action Items

8.         HACEP:  Discussion and action regarding resolution # 2556 authorizing the Chief Executive Officer to sign contract renewal for Yardi Voyager license contract # IT-16-C-0021 for the Housing Authority and its affiliates.                

9.         HACEP:  Discussion and action regarding resolution # 2550 approving the Section 8 Management Assessment Program (SEMAP) certification for fiscal year ending December 31, 2020.                                                                             

10.       HACEP:  Discussion and action regarding resolution # 2555 authorizing the Chief Executive Officer to declare obsolete inventory as salvage inventory and to conduct public sale of salvage inventory.                                                      

11.       HACEP/Affiliated PFCs and Entities:  Discussion, consideration, and action regarding resolution # 2551 conducting the election of officers for the Board of Commissioners of the Housing Authority and its affiliates.

            a.  Election of Board Chairperson.

            b.  Election of Board Vice-Chairperson.

12.       HACEP:  Discussion and action regarding Chief Executive Officer’s performance evaluation, employment agreement, and terms of employment.                       

D.        Regular Agenda:  Action Items for Specific Residential Developments

13.       Montana Uptown Site

            a.   HACEP:  Discussion and action regarding resolution # 2552 to approve abatement and demolition at 910/916 Kansas properties at the Montana Uptown Site.                                                                                

            b.   PHRC:  Discussion and action regarding resolution # 188 approving funding for demolition and abatement at the Montana Uptown Site located at 910/916 Kansas Avenue.                                                                      

14.       Tays North

            a.   HACEP:  Discussion and action regarding resolution # 2553 authorizing modification of the GMP construction agreements between the Housing Authority of the City of El Paso (“HACEP”) and Affordable Housing Enterprises (“AHE”) related to the redevelopment of the Tays North (the “Project”) and utilization of hard cost contingency funds for the project. 

            b.   AHE:  Discussion and action regarding resolution # 074 authorizing modification of the GMP construction agreements between Affordable Housing Enterprises (AHE) and Sundt Construction, related to the redevelopment of the Tays North (the “Project”) and utilization of hard cost contingency funds for the project.                                                                                    

15.       Blue Flame-Base Building Contract

           a.  HACEP:  Discussion and action regarding resolution # 2557 authorizing modification of the GMP construction agreements between the Housing Authority of the City of El Paso (“HACEP”) and Affordable Housing Enterprises (“AHE”) related to the redevelopment of the Blue Flame Base Building (the “Project”) and utilization of hard cost contingency funds for the project.

           b.   AHE:  Discussion and action regarding resolution # 075 authorizing modification of the GMP construction agreements between Affordable Housing Enterprises (AHE) and Sundt Construction related to the redevelopment of the Blue Flame Base Building (the “Project”) and utilization of hard cost contingency funds for the project.

16.      Blue Flame-14-16th Floors Contract

           a.   HACEP:  Discussion and action regarding resolution # 2558 authorizing modification of the GMP construction agreements between the Housing Authority of the City of El Paso (“HACEP”) and Affordable Housing Enterprises (“AHE”) related to the redevelopment of the Blue Flame 14-16 floors (the “Project”) and utilization of hard cost contingency funds for the project.

           b.   AHE:  Discussion and action regarding resolution # 076 authorizing modification of the GMP construction agreements between Affordable Housing Enterprises (“AHE”) and Sundt Construction, related to the redevelopment of the Blue Flame 14-16 floors (the “Project”) and utilization of hard cost contingency funds for the project.

17.      Central Office Cost Center

           a.   HACEP:  Discussion and action regarding resolution # 2554 to authorize a lease of and disposition and/or release of declaration of trust for the Central Office Cost Center property and its contents/equipment.        

E.        HACEP Reports

18.       (a) Secretary’s report.

            *  Update and discussion of new process to record the minutes for HACEP and the affiliates.

            *  Update on public health and safety and business continuation measures during the coronavirus/COVID-10 pandemic.

            *  RAD update.

19.       Chief Financial Officer reports.

            *  Statement of revenues/expenses for quarter ending December 31, 2020.

            *  Statement of changes in net assets for quarter ending December 31, 2020.

20.       Report on changes and/or contract modifications pursuant to delegation of authority under Section 7 of the Development Procedures Manual.

F.         Executive (Closed) Session

21.       Executive Session.

The Board of Commissioners may go into executive session, or a closed private session, to take up any items on or related to this agenda that may be appropriately taken up in executive session pursuant to the Texas Open Meetings Act, Texas Government Code 551.071 to .076, for such matters as consultation with an attorney on a matter covered by attorney-client privilege, to confer regarding threatened or pending litigation, or to confer regarding real estate, personnel, and/or security matters that may be discussed in a closed session.   No action and no votes will be taken in any executive session.

This notice has been posted at the central offices of the Housing Authority, 5300 East Paisano Drive, and notice has been provided to the El Paso County Clerk more than 72 hours in advance of the above meeting, as required by chapter 551 of the Texas government code.
